Tenant Fees and Charges
On 1st June 2019 the law in relation to tenant fees and charges changed. With effect from this date a tenant (or anyone acting on their behalf or guaranteeing their rent) cannot be required to make certain payments in connection with a tenancy.
The only payments which can be charged in connection with a tenancy are:
Rent - the amount which will be contractually payable at regular intervals to rent the property
Refundable Tenancy Deposit - capped at no more than 5 weeks rent where the annual rent is less than £50,000, or 6 weeks rent where the total annual rent is £50,000 or above. This deposit can be used to cover damages or defaults of the tenant during the tenancy
Changes to Tenancy - when requested by the tenant, capped at £50 (incl.VAT), or reasonable costs incurred if higher
Early Termination of Tenancy - when requested by the tenant.
Utilities/Council Tax - communication services, TV licence
Default Fee for Late Payment of Rent - Chargeable from 14 days arrears calculated on the interest at 3% above Bank of England base rate on the late payment of rent for each day that the payment is outstanding
Lost Key/Access/Other Security Device (e.g. Fob, electronic device for garage doors / security gates) where required under a tenancy agreement.
Refundable Holding Deposit - (to reserve a property) capped at no more than one weeks’ rent
Holding Deposit:
The property will be reserved on payment of the Holding Deposit. The deadline for agreement is 15 calendar days after the Holding Deposit is paid unless an “extension” date is agreed in writing by the tenant.
The Holding Deposit will be refunded to the tenant within 7 days of:-
- Entering into a tenancy agreement unless the tenant has agreed in writing for the Holding Deposit to be put towards the balance of monies payable.
- The landlord choosing to withdraws
- An agreement not being reached before the Deadline for Agreement or the extended date and the tenant is not at fault, or
- If the landlord or the agent breaches the fee ban or acts in a way that it would be unreasonable to expect the tenant to enter into a tenancy agreement (i.e. Unfair terms, harassment etc)
The Agent can retain the Holding Deposit only if:-
- The tenant withdraws their application
- The tenant doesn’t take reasonable steps to enter into the tenancy
- The tenant fails a Right to Rent check
- The tenant provides false or misleading information which materially affects their suitability to rent the property
Referencing and Right to Rent Checks
Acceptance of any offer would be subject to contract, referencing and immigration checks.
You will be asked to complete an application before referencing can be undertaken, you should also provide an original photographic Identification (e.g. Passport, National id card, visa, resident permit, driving licence) and Proof of Residence (e.g. Original utility bill, council tax bill, or bank statement all of which must be less than 3 months old) if you have any queries regarding this please do not hesitate to ask us.
The need for a guarantor may not become apparent until your referencing (including references for any joint tenants) has been completed. Where a guarantor is required, they will need to complete an application form and provide photographic identification and proof of residence.
Referencing will cover a check against the credit file and public records of the individual, an Anti-Money Laundering check, confirmation of employment and salary details, confirmation of previous tenancy details, right to rent checks, reporting the results of all of those checks to your prospective landlord to see if your application is acceptable.
Tenant Fees Act 2019 and Existing Tenancies
Under the Tenant Fees Act 2019 there are transitional provisions where fees are written into existing tenancy agreements. These apply to all tenancy agreements granted or signed and executed before 31st May
